Defective products blamed for loss of man's eye

Fireworks are synonymous with the Fourth of July holiday in Texas and elsewhere around the country. While many people attend organized fireworks events, more and more families are purchasing fireworks for their own individual displays. As sales for fireworks increase, accidents do as well. A man in another state filed a products liability lawsuit against a fireworks manufacturer after the company's apparently defective products caused a catastrophic injury.

In 2013, the man went to a fireworks store to purchase items for his annual Independence Day celebration. After making his selections, the store staff recommended an additional item, a hexagonal firework with multiple tubes. When this firework was ignited, a ball of fire hit the man's face. The man experienced the loss of one eye and loss of vision in the other.

The lawsuit claims that the proper safety fuse was not on the firework and that it also had a bent tube. Also, there were no warning labels to alert users to check for safety fuses. The lawsuit contends that the fireworks company should have made sure the safety fuse was included. It is asserted that a thorough inspection of the product was necessary before it was sold. While a jury trial has been requested, a state supreme court is addressing the issue of apportionment of fault related to this suit.
